The Client:

A large manufacturer and producer of vinyl extrusions..

 

The Situation:

A claimant filed a Claim Petition alleging a workplace injury which claimant argued resulted in ongoing disability that could amount to $140,000 in wage losses alone..

 

The Chartwell Solution:

The claimant was successfully discredited by showing that when he advised the employer about his back problem, he did not state that it was related to a work injury.  Hospital records further indicated that the claimant’s injury occurred at home.

Given the inconsistencies in claimant's testimony, claimant’s treating physician was also found to be not credible because she relied on the claimant to provide her with an accurate history. The Judge further doubted her opinions as they were contradicted by the claimant's medical records. Accordingly, the Judge denied the claim in its entirety.
