Andrew E. Greenberg files Amicus Curiae Brief addressing controversial workers’ compensation “pension offset” in The Pennsylvania State University v. Workers’ Compensation Appeal Board (Hensal) matter
Chartwell partner, Andrew E. Greenberg, Esquire, recently filed an Amicus Curiae Brief with the Commonwealth Court of Pennsylvania, addressing what has become a highly contested issue throughout Pennsylvania – the application of the “pension offset” contemplated by Section 204(a) of the Pennsylvania Workers’ Compensation Act. Preparing the Brief at the request of the Pennsylvania Defense Institute, Mr. Greenberg offered argument in support of the pension offset methodology implemented by the Pennsylvania State Employees’ Retirement System in the appellate matter, The Pennsylvania State University v. Workers’ Compensation Appeal Board (Hensal). By Order dated May 2, 2006 the Commonwealth Court rescinded its March 9, 2006 Opinion and Order, which affirmed the workers’ compensation judge’s denial of the employer’s pension offset and agreed to entertain re-argument in the case en banc.
