Chartwell partner, Andrew E. Greenberg, Esquire files Amicus Curiae Brief with Commonwealth Court on behalf of The Pennsylvania Defense Institute, addressing controversial "pension offset" issue in The Pennsylvania State University v. Workers' Compensation Appeal Board (Hensal)
Chartwell Law Offices partner, Andrew E. Greenberg has completed and filed with the Commonwealth Court of Pennsylvania an Amicus Curiae Brief on behalf of The Pennsylvania Defense Institute addressing the controversial "pension offset" issue that has been discussed at great length by the legal community and the courts over the past year. Filed in support of the Petition for Review presented by the employer in The Pennsylvania State University v. Workers' Compensation Appeal Board (Hensal), the Brief offers a global review of the "offset" provision set forth in Section 204(a) of the Pennsylvania Workers' Compensation Act and a thorough explanation for the role that actuarial analysis plays in the administration of defined benefit pension plans.
