Clifford A. Goldstein successfully defends high exposure Pennsylvania Workers’ Compensation Claim Petition alleging development of cancer condition resulting from occupational exposures
Chartwell attorney Clifford A. Goldstein recently successfully defended Hoeganaes Corporation in connection with a Pennsylvania Workers’ Compensation Claim Petition filed by a “blending operations technician” who alleged the development of lung cancer as a result of occupational exposures to nickel and methylenechloride. In doing so, Mr. Goldstein prepared and filed with the presiding workers’ compensation judge a “Frye” Motion challenging the scientific bases for the expert medical testimony presented by claimant in support of his claim. In addition, through effective cross-examination of claimant’s medical expert, the preparation of an onsite demonstration for the presiding judge and the presentation of an impeccably qualified occupational disease expert, Mr. Goldstein established as a matter of fact the non-work-related character of claimant’s physical condition.
