Ben is experienced defending first-party commercial property damage and business interuption claims involving varied businesses, agricultural entities and jewelers.  Ben is also well versed in handling homeowners claims arising under specified peril and all-risk policies such as hurricane and windstorm losses, sinkholes, building collapse, fire, water claims, cast-iron pipe claims, mysterious disappearance and burglary.  Prior to focusing on his practice on property insurance, Ben represented plainitffs in commercial and personal disputes.

Some of Ben’s prevailing representative matters include:

  • Plastic Surgery Center, PA v. Malouf Chevrolet – Cadillac, Inc., 457 N.J. Super. 565 (App. Div. 2019) (setting precedent on the statute of limitations for medical provider claims under New Jersey Workers’ Compensation statutes)
  • Mehta v. Fairleigh Dickinson University, 530 Fed. App’x. 191 (3rd Cir. 2013) (reversing summary judgment granted to private university on plaintiff’s racial discrimination claim)
  • Capodici v. City of Jersey City, 2005 WL 2452698 (D.N.J. 2005)(denying summary judgment to police officers on plaintiff’s civil

Immediately prior to joining Chartwell Law, Ben was part of the insurance coverage team for a Tampa, Florida law firm, after relocating from New Jersey
