John J. Winter is Partner and chairman of the Creditors’ Rights Department at Chartwell Law Offices, LLP where he is continuing his representation of commercial lenders. Prior to Chartwell, Mr. Winter resided at Harvey, Pennington Ltd. Acting as Shareholder in charge of Financial Institutions Department. He was member of the firm’s Executive Committee since 2004. Mr. Winter developed the practice to include commercial and residential foreclosures, replevins, liquidation of federally guaranteed commercial loans, loan documentation, and restructuring. While at Harvey, Pennington, Mr. Winter represented banks, commercial factors and trade creditors in connection with secured lending, loan documentation, and loan liquidations, as well as bankruptcy matters, including: stay relief, cash collateral and adequate protection issues; post-petition transactions, debtor-in-possession financing, asset sales, assumption/rejection of executory contracts; claims litigation; creditors’ committee formation and governance; professional retention and compensation; objections to exemptions and discharge; avoidance and turnover actions; plan disclosure, solicitation and confirmation issues. He also documented and closed secured commercial loans, reviewed and negotiated commercial leases. Mr. Winter successfully defended lender liability claims under Real Estate Settlement Procedures Act, Truth in Lending Act, Equal Credit Opportunity Act, and related consumer protection statutes. Lastly, he reviewed and negotiated commercial real estate leases.
