Avery W. Martinez counsels and defends clients in a diverse array of matters in federal and state courts. He focuses his practice on commercial litigation, commercial general liability, and insurance coverage.

Avery handles disputes through all stages of litigation, including witness depositions, dispositive motions, trial preparation, and alternative dispute resolution. He works closely with self-insured companies, insurers, and underwriters to evaluate exposure and develop strategies that take their business needs into account. Throughout each matter, he focuses on finding practical ways to resolve disputes while protecting his clients’ interests.

Avery also advises international and domestic insurers on insurance coverage disputes concerning declaratory judgment actions, threshold coverage issues in the context of first-party property claims, bad faith claims, extra-contractual claims, breach of contract, subrogation, and indemnity recoveries across various lines of insurance.

Prior to joining Chartwell, Avery practiced at a national law firm, where he represented clients in matters involving breach of contract disputes, consumer product liability in multidistrict litigation, mass torts, and construction defects. His broad experience across a range of litigation matters has provided him with a strong foundation for delivering well-rounded and effective guidance to clients.

During law school, Avery gained valuable experience as a summer associate and law clerk at several Philadelphia-area law firms. He also served as a judicial extern for the Honorable Sherry R. Fallon of the U.S. District Court for the District of Delaware, where he observed trials, hearings, conferences, mediations, and other legal proceedings. Avery received several academic distinctions, including the Certificate of Achievement for stellar performance in Torts and the Outstanding Student Service Award. He participated in the Intensive Trial Advocacy Program, was a finalist in the Alternative Dispute Resolution Society Negotiation Competition, and later served on the organization’s Executive Board as Vice President and Competitions Chair.

Outside of work, Avery enjoys learning American Sign Language, participating in run clubs, and spoiling his nieces and nephew.
