Whitney Fay is a seasoned attorney with nearly a decade of experience advising employers, insurers, and businesses on labor and employment matters, EPLI claims, personal injury defense, and related commercial litigation. Her practice is informed by a broad litigation background that includes defending public entities, representing national insurers, and counseling private businesses through sensitive workplace disputes and liability matters.
Whitney has extensive experience handling employment-related disputes, including discrimination, retaliation, wage and hour matters, union issues, executive employment agreements, severance negotiations, and policy and handbook review. She routinely counsels clients on personnel management, compliance, and litigation avoidance strategies, and has represented national insurers in EPLI matters as well as large retailers and businesses in personal injury defense litigation. Her work also includes business and commercial litigation, contract drafting and negotiation, and select transactional matters involving real estate and corporate governance. Earlier in her career, Whitney served as an Assistant Attorney General, defending state agencies in a variety of civil litigation matters, and as a judicial law clerk to two judges of the Missouri Court of Appeals.
Highly engaged in the legal community, Whitney is a regular CLE presenter on labor and employment topics and has served in leadership roles with the Missouri Bar and the Kansas City Metropolitan Bar Association, including service on the Missouri Bar Board of Governors and Young Lawyers Section Council. She is a member of the Earl E. O’Connor American Inn of Court and has long promoted civic education as a law school instructor for Missouri Boys and Girls State. A Columbia, MO native and proud Mizzou Law alumna, Whitney is a lifelong Missourian and the daughter of a rural Missouri lawyer–a background that continues to shape her approach to advocacy and mentorship.
