Chartwell Wins Federal Jury Verdict in Georgia Veil-Piercing Case

Chartwell’s Atlanta team achieved a major victory in federal court last week. Robert Luskin, Willie Black, Kelsey Gilbert, and Graham Newsome represented plaintiff Ray Garbiras in a business dispute arising from the 2021 sale of his logistics company.

Garbiras sold the company to Celestina Dungy and her company, Alex Logistics, but the buyers failed to pay him what he was owed under the terms of the sale. Garbiras retained Chartwell to pursue claims for breach of contract, fraud, and related causes of action against Dungy, Alex Logistics, and affiliated entities.

Last summer, the United States District Court for the Northern District of Georgia entered judgment in favor of Garbiras and against Alex Logistics in the amount of $2,353,612.32. The remaining question was whether Dungy could be held personally responsible for the judgment against Alex Logistics.

At trial, which began August 10, 2026, the sole issue was whether Dungy could be held liable for the judgment under a corporate veil-piercing theory. Veil piercing is an extraordinary remedy that applies only in limited circumstances.

Following a two-day jury trial in federal court in Gainesville, Georgia, the jury found in favor of Garbiras, holding Dungy personally responsible for the judgment against Alex Logistics.
