Michael Kranzler obtained a Voluntary Dismissal with Prejudice when opposing counsel agreed to vacate a settlement in order to avoid a Motion to Dismiss for Fraud Upon the Court.

Michael had originally moved for summary judgment on behalf of his client based on the invalidity of an Assignment of Benefits contract assigning benefits to a roofer. The underlying insureds then contacted the carrier’s adjuster and raised red flags as to viability of the roofer’s cause of action, as well as to the roofer’s conduct and the underlying cause of the loss.  Michael used that information to convince the roofer’s counsel to agree to vacate the settlement and file a Notice of Voluntary Dismissal with Prejudice.
