UPDATE: New Hearing Procedures Before the Maryland Workers’ Compensation Commission

On May 12, 2020 the Maryland Workers’ Compensation Commission announced that it may resume in-person hearings effective June 8, 2020. It is already issuing notices for in-person hearings and is currently conducting video remote hearings (“VRH”) per its April 23, 2020 announcement. The parties must electronically submit their exhibits at least three business days before the all hearings.

While the Maryland Workers’ Compensation Commission has postponed all in-person hearings through June 5, 2020, effective April 23, 2020, the commission will allow the parties to request a video remote hearing (“VRH”). Both parties must agree to a VRH. Once both parties agree to proceed with a VRH, they must electronically file an emergency hearing request, including the names and email addresses of all witnesses. The parties must also electronically submit their exhibits at least three business days before the VRH. A commissioner may permit supplemental exhibits to be submitted during the VRH, such as for impeachment purposes. The VRH instructions do not provide for disclosure of witnesses for impeachment purposes during the VRH.
