Tom is committed to obtaining the best possible results for his clients, whether that means settling a minor claim early in litigation to save the client’s time and expense or whether it requires pursuing a matter to the Pennsylvania Supreme Court.  He has ensured the closure of thousands of cases for his clients.  Tom has also been successful in recovering millions of dollars for his clients in Supersedeas Fund Reimbursement.  He has also saved his clients millions by creative and effective litigation practices.

Tom has successfully defended many matters since 1995, including the following:

  • Obtaining a suspension of claimant’s wage loss benefits for a large self-insured employer by establishing that the claimant was totally disabled due a non-work-related condition (SEPTA v. Cunningham).
  • Securing early dismissal of a claimant’s Review and Reinstatement Petitions based on the legal principles of res judicata and collateral estoppel without incurring the expense associated with protracted litigation and costly medical expert depositions.
  • Settlement of a case for just three months of wage loss benefits, with no admission of liability, and no payment of any medicals, in a matter that involved surgery.
  • Resolving a matter for just seven months of wage loss benefits, with no admission of liability, on a case involving surgeries to multiple body parts, while saving our client the expense associated with protracted litigation and costly expert deposition testimony.
  • Securing the withdrawal of a Claim Petition by claimant’s counsel and the claim in its entirety, with no money paid by defendant, due to assertive litigation approach involving presentation of favorable defense surveillance evidence at the first hearing thereby convincing claimant’s counsel to withdraw the Claim Petition and his representation of the claimant.
